White-Collar Crime
For business owners, the sheer number of criminal offences and their often opaque structure and placement in the law are almost impossible to keep track of. Settling for the second-best solution is often enough to come into conflict with white-collar criminal law.
We see ourselves as a counterweight to the state prosecuting authorities. Particularly in complex white-collar criminal proceedings, one-sided investigations often obscure the factual and legal situation. We counter this by clarifying, analysing and legally assessing the facts as early as possible and confronting the authorities and courts with the resulting antithesis. Ideally, this happens as early as the investigation or interim proceedings and can spare the client from appearing at a main trial. But we can also ensure that the law prevails in main trials or appeal proceedings and before the constitutional courts.
Since in many areas of white-collar and tax criminal law the facts and legal issues of the criminal proceedings and the related administrative proceedings are largely identical and in practice influence each other, we often represent our clients in both proceedings. We also help our clients fend off imminent confiscation and/or asset freezing measures.
We help victims of white-collar crime to recover the assets taken from them. As in criminal defence, we first clarify the factual and legal situation, use it to determine the best recovery strategy for our clients and implement this strategy proactively.
